Dear Senator,
You will soon be considering S. Con. Res. 33, a concurrent resolution setting forth the congressional budget for the United States Government for fiscal year 2026 and the appropriate budgetary levels for fiscal years 2027 through 2035. On behalf of the more than one million members and supporters of the Council for Citizens Against Government Waste (CCAGW), I urge you to oppose the following amendments which would implement Most Favored Nation (MFN) policies and other forms of price controls:
Amendment #5159, offered by Sen. Bernie Sanders (I-Vt.), which would codify MFN policies.
Amendment #5336, offered by Sen. Ron Wyden (D-Ore), which would require a study on the effects of a federal agency negotiating an MFN deal with pharmaceutical manufacturers.
Amendment #5028, offered by Sen. Peter Welch (D-Vt.), which would repeal exemptions from Medicare price negotiations for orphan drugs.
Codifying MFN policies that would import price controls from countries with socialized medicine will lead to shortages, disrupt markets, slow medical innovation, threaten American jobs, fail to stop foreign freeriding on American research and development, and have a disastrous effect on patients. An August 2022 University of Chicago issue brief found that price controls would increase healthcare spending by $50.8 billion over the next 20 years and lead to 135 fewer drugs, which will negatively impact 2.47 million patients. Many of these arguments were cited in a February 12, 2026, coalition letter opposing the codification of MFN by Congress signed by 52 organizations including CCAGW.
For these reasons, I urge you to oppose any amendments that would adopt MFN policies and any other form of price controls. All votes on S. Con. Res. 33 may be considered for CCAGW’s 2026 Congressional Ratings.
